Welcome to Limitless NRG Solutions! We are dedicated to providing exceptional electrical services to our valued clients across the Sunshine Coast and North Brisbane. These Terms & Conditions outline the agreement between you (the Client) and Limitless NRG Solutions for the provision of electrical works, services, and products.

Please read these terms carefully. By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

1. Definitions

  • “Limitless NRG Solutions,” “We,” “Us,” “Our” refers to Limitless NRG Solutions, its employees, and authorised contractors.
  • “Client,” “You,” “Your” refers to the person, firm, or entity engaging our services.
  • “Services” means all electrical work, installations, repairs, maintenance, consultations, and products supplied by Limitless NRG Solutions.
  • “Site” means the location where the Services are to be performed.
  • “Quote” means a written estimation of costs for the proposed Services.
  • “Works” means the electrical services and any associated materials provided.

2. Engagement & Scope of Works

  • All requests for Services must be clear and provide sufficient detail to allow Us to assess the requirements.
  • The specific scope of Works will be detailed in Our Quote or, for smaller jobs, as agreed verbally and documented on the invoice.
  • Any variations or additions to the agreed scope of Works must be requested in writing (email acceptable) and may incur additional charges. We will endeavour to provide an updated or separate Quote for such variations.

3. Quotes & Pricing

  • Quotes provided by Limitless NRG Solutions are valid for thirty (30) days from the date of issue, unless otherwise stated.
  • Quotes are based on the information provided by the Client and Our assessment of the Site at the time of quoting. Unforeseen issues or changes to the Site conditions may necessitate a variation to the Quote.
  • All prices are in Australian Dollars (AUD) and are inclusive of GST, unless otherwise stated.
  • Our pricing is based on standard working hours Monday to Friday, excluding public holidays. Work requested outside these hours may attract higher rates, which will be communicated to You.
  • Emergency call-out fees may apply and will be advised at the time of Your call.

4. Payment Terms

  • Payment for Services is due upon completion of the Works, unless alternative arrangements have been agreed upon in writing with an authorised representative of Limitless NRG Solutions.
  • For larger projects, We may require a deposit prior to commencement, and progress payments may be stipulated in the Quote.
  • We accept payment by EFT, Credit Card (Visa/Mastercard), Cash. Credit card payments may attract a surcharge.
  • Overdue accounts may incur interest at a rate, calculated daily.
  • Any costs incurred by Limitless NRG Solutions in recovering overdue payments, including debt collection agency fees or legal costs, will be payable by the Client.
  • Ownership of any goods or materials supplied as part of the Services does not pass to the Client until full payment has been received.

5. Client Responsibilities

  • The Client must provide Us with safe and clear access to the Site to perform the Services.
  • The Client is responsible for ensuring that the Site is free from hazards that could impede Our work or endanger Our personnel. This includes securing pets and advising of any known risks.
  • The Client must provide access to electricity, water, and other amenities reasonably required by Us to perform the Services.
  • The Client warrants that they are the owner of the Site or have the authority of the owner to engage Our Services.
  • It is the Client’s responsibility to inform Us of the location of any hidden services, pipes, or cables at the Site. Whilst We will take all reasonable care, We will not be liable for damage to unmarked or incorrectly marked services.

6. Warranties & Guarantees

  • Limitless NRG Solutions warrants that all Services will be performed in a professional and workmanlike manner, in accordance with relevant Australian Standards and industry best practices.
  • We provide a 12-month warranty on Our workmanship from the date of completion.
  • Materials and products supplied by Us are covered by their respective manufacturer’s warranties. We will assist You in making a claim under a manufacturer’s warranty where appropriate.
  • This warranty does not cover defects arising from:
    • Misuse, neglect, or accidental damage by the Client or a third party.
    • Tampering or modification of the Works by anyone other than Limitless NRG Solutions.
    • Normal wear and tear.
    • Failure to follow Our instructions or recommendations.
    • Pre-existing conditions at the Site not disclosed to Us or not part of the agreed scope of Works.
    • Damage caused by vermin, pests, or acts of God.
  • To make a warranty claim, please contact Us in writing, providing details of the issue and proof of engagement (e.g., invoice number). We will assess the claim and respond within a reasonable timeframe.

7. Cancellations & Rescheduling

  • If You need to cancel or reschedule a booked Service, please provide Us with at least 24 hours’ notice.
  • Cancellations made with less than 24 hours’ notice, or if We are unable to gain access to the Site at the agreed time, may incur a cancellation fee or a call-out charge.
  • Limitless NRG Solutions reserves the right to reschedule Services due to unforeseen circumstances (e.g., extreme weather, staff illness) and will provide You with as much notice as possible.

8. Liability & Indemnity

  • Limitless NRG Solutions maintains current Public Liability Insurance. A certificate of currency can be provided upon request.
  • To the fullest extent permitted by law, Our liability for any loss, damage, or claim arising out of or in connection with the Services or these Terms & Conditions is limited to the value of the Services provided.
  • We are not liable for any indirect, consequential, or economic loss, including loss of profit or business interruption.
  • The Client indemnifies Limitless NRG Solutions against all claims, losses, damages, costs, and expenses incurred by Us arising from any breach of these Terms & Conditions by the Client, or any negligent act or omission by the Client.

9. Electrical Safety & Compliance

  • All electrical work will be carried out in accordance with the Electrical Safety Act 2002 (Qld), the Electrical Safety Regulation 2013 (Qld), AS/NZS 3000 (Wiring Rules), and other relevant codes and standards.
  • Upon completion of relevant electrical work, We will provide an Electrical Certificate of Compliance where required by legislation.

10. Dispute Resolution

  • We are committed to client satisfaction. If You have any concerns or are dissatisfied with Our Services, please contact Us directly at 1300 538 498 or via email. We will endeavour to resolve the issue promptly and fairly.
  • If a dispute cannot be resolved through direct negotiation, both parties agree to attempt mediation through a mutually agreed-upon mediator before pursuing other legal remedies.

11. Photography & Media

  • Limitless NRG Solutions may take photographs or videos of the Works (before, during, and after) for quality control, training, and marketing purposes. We will ensure that any media used does not compromise Your personal privacy unless Your express consent is obtained for testimonials or specific case studies.

12. Privacy

  • We collect and manage Your personal information in accordance with Our Privacy Policy, available on Our website.

13. Amendments

    • Limitless NRG Solutions reserves the right to amend these Terms & Conditions at any time. The current version will always be available on Our website. Any changes will apply to Services engaged after the date of the amendment.

14. Governing Law

  • These Terms & Conditions are governed by the laws of Queensland, Australia. Both parties agree to submit to the non-exclusive jurisdiction of the courts of Queensland.
